TCPA (Telephone Consumer Protection Act)

The U.S. federal law governing calls and texts to consumers, including consent requirements for automated and artificial-voice calls to mobile phones.

The FCC has ruled that AI-generated voice is an artificial voice under the TCPA. Informational calls need prior express consent; marketing calls need prior express written consent. Alpha Drive uses AI only for consented, transactional outreach and live agents for promotional outreach. This entry is a summary, not legal advice.

What it means for dealership outbound

In February 2024 the FCC confirmed that AI-generated voices are artificial voices under the TCPA. That places AI outbound calls to mobile numbers under the same consent rules as prerecorded calls: prior express consent for informational contact such as appointment reminders or recall notices, and prior express written consent for marketing. Several states add their own requirement that automated callers disclose they are not human at the start of the call.

How Alpha Drive structures around it

Outbound Pro handles consented, transactional outreach with identification, AI disclosure, quiet-hours and opt-out enforcement and a logged consent basis on every contact. Promotional, sales-event and conquest outreach goes to Live Assist agents. This entry summarizes the framework and is not legal advice; consult counsel on your store's consent practices.
